CashStash KC Treasure Hunt Terms and Conditions

Please read these Terms and Conditions before participating.

1. Agreement to These Terms

These Terms apply to all in-person, online, social media, clue-based, promotional, and hybrid treasure hunts, cash drops, challenges, contests, and related events operated by CashStash KC, each referred to as a "Hunt."

You participate when you take any action intended to enter a Hunt, solve a clue, search for a location, retrieve a token or prize, submit an answer, attend an organized Hunt event, or claim a prize.

By participating, you confirm that you have read, understood, and voluntarily agreed to these Terms. If you do not agree, do not participate.

Each Hunt may also include a post, caption, webpage, video, announcement, or separate rules containing Hunt-specific instructions. Those instructions are incorporated into these Terms. If Hunt-specific rules conflict with these Terms, the Hunt-specific rules control only for that Hunt's administration. The safety, assumption of risk, release, and prohibited conduct provisions below remain in effect unless CashStash KC expressly states otherwise in writing.

2. Eligibility

Unless Hunt-specific rules state a higher age:

• A prize claimant must be at least 18 years old.
• A person under 18 may accompany a parent or legal guardian but may not search independently or claim a prize directly.
• The supervising parent or legal guardian is the participating claimant and is responsible for the minor's conduct and safety.
• CashStash KC may require government-issued identification and proof of eligibility before awarding a prize.
• Anyone involved in planning, producing, hiding, administering, or receiving confidential information about a Hunt is not eligible.
• Members of an excluded person's immediate household are also not eligible unless CashStash KC gives written approval.
• Participation is void wherever prohibited or restricted by law.

CashStash KC may deny participation or a prize when it reasonably determines that eligibility requirements have not been met.

3. No Purchase Necessary

Standard CashStash KC Hunts are free to enter, and no purchase or payment is necessary.

CashStash KC may offer separate ticketed events, paid experiences, raffles, drawings, or other promotions only under separate written rules and any legally required conditions. Any refund policy for a paid event will be stated before purchase.

4. Personal Responsibility

Participation is voluntary. Each participant is solely responsible for:

• Assessing their own health, physical ability, surroundings, equipment, transportation, and level of risk.
• Choosing whether to continue or stop searching.
• Wearing suitable clothing and footwear.
• Remaining aware of traffic, weather, terrain, other people, animals, and changing conditions.
• Keeping children and accompanying guests under direct supervision.
• Obeying all laws, signs, property rules, operating hours, and instructions from law enforcement, property owners, venue staff, or emergency personnel.
• Paying any personal medical, transportation, parking, towing, property damage, or other expenses connected with participation, subject to applicable law.

Never assume an action is safe merely because it appears related to a clue.

5. Stop if Something Appears Unsafe

CashStash KC never requires or authorizes a participant to take an illegal, dangerous, destructive, or unreasonable action.

If a clue appears to point toward a dangerous or prohibited location, stop. You may have interpreted the clue incorrectly, site conditions may have changed, or the Hunt may have been paused.

Do not touch or remove an item unless it clearly matches the Hunt instructions and any identifying CashStash KC markings. Do not handle any object that appears damaged, opened, suspicious, hazardous, or inconsistent with the clue.

A participant should immediately stop searching when instructed by CashStash KC, law enforcement, a property owner, venue staff, or emergency personnel.

6. Prohibited Locations and Actions

No Hunt requires or permits you to:

• Trespass or enter private property without clear permission.
• Enter a closed, locked, fenced, posted, restricted, staff-only, or nonpublic area.
• Enter a building, vacant property, construction area, demolition site, tunnel, storm drain, sewer, utility area, maintenance area, rooftop, bridge structure, or condemned property.
• Walk or stop on railroad tracks, railroad property, an active roadway, highway shoulder, median, or other area closed to pedestrians.
• Enter deep water, moving water, ice, drainage channels, steep drops, unstable ground, or another hazardous natural area.
• Climb a tree, fence, wall, pole, sign, roof, structure, monument, vehicle, or other object.
• Dig, cut, pry, break, force, dismantle, or move a fixed or heavy object.
• Open a mailbox, vehicle, utility box, electrical enclosure, emergency device, locked container, or item that does not belong to you.
• Damage landscaping, buildings, signs, public art, equipment, vehicles, or other property.
• Use a weapon, destructive tool, or dangerous device.
• Fly a drone in violation of law or over people or property without permission.
• Block traffic, sidewalks, doors, businesses, emergency access, or other participants.
• Push, threaten, stalk, chase, intimidate, fight, or make unwanted physical contact with another person.
• Follow CashStash KC staff, sponsors, photographers, or vehicles in an attempt to locate a prize.
• Move, hide, destroy, copy, replace, or create a fake clue, token, container, or prize.
• Impersonate CashStash KC, a sponsor, a winner, or another participant.

A clue does not grant permission to enter property or ignore a law, warning, closure, or instruction.

7. Driving and Transportation

Do not read clues, record video, post online, search, or use a mobile device while operating a vehicle.

Drivers must park legally before reviewing Hunt materials or searching. Participants may not stop suddenly, block a road, park illegally, drive onto restricted property, or leave a vehicle where it creates a hazard.

CashStash KC is not responsible for traffic violations, parking tickets, towing, vehicle damage, collisions, or injuries related to transportation.

8. Property and Location Conditions

Hunts may occur in public areas, businesses, parks, venues, or private locations used with permission. CashStash KC may not own, possess, maintain, inspect, or control those locations.

Permission to place a prize at a location does not guarantee that the property is free from hazards or that access will remain available. Weather, construction, business hours, security rules, public events, crime, maintenance, crowds, and government action may affect a location without notice.

Participants must leave immediately if asked by a property owner, employee, security officer, law enforcement officer, or authorized representative.

Participants are responsible for any property damage they cause.

9. Assumption of Risk

Treasure hunting may involve risks that are known, unknown, expected, unexpected, natural, or caused by other people.

Risks may include:

• Slips, trips, falls, cuts, sprains, broken bones, illness, disability, or death.
• Vehicle traffic, bicycles, scooters, parking lots, road conditions, and distracted drivers.
• Uneven terrain, holes, stairs, curbs, mud, snow, ice, water, broken glass, debris, and falling objects.
• Heat, cold, storms, lightning, wind, poor air quality, darkness, and other weather conditions.
• Animals, insects, plants, allergens, and environmental exposure.
• Crowds, physical exertion, panic, confrontation, crime, theft, or the conduct of other participants or members of the public.
• Inaccurate maps, GPS errors, delayed clues, mobile device failures, loss of service, and online misinformation.
• Property conditions that CashStash KC did not create, know about, inspect, or control.
• The ordinary negligence of one or more Released Parties, as defined below.

By participating, you knowingly and voluntarily assume full responsibility for these and all other risks connected with the Hunt, to the fullest extent permitted by law.

10. Release of Liability and Covenant Not to Sue

The "Released Parties" include CashStash KC, its owners, members, managers, officers, employees, contractors, volunteers, representatives, affiliates, sponsors, advertisers, prize providers, vendors, venues, property owners, property occupants, municipalities, event partners, and each of their respective insurers, successors, and assigns.

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU RELEASE AND FOREVER DISCHARGE THE RELEASED PARTIES FROM CLAIMS, DEMANDS, ACTIONS, DAMAGES, LOSSES, COSTS, OR LIABILITY ARISING FROM OR RELATED TO YOUR PARTICIPATION IN A HUNT.

This release includes claims involving bodily injury, illness, death, emotional distress, property damage, theft, financial loss, or other harm caused in whole or in part by the ordinary negligence or fault of a Released Party.

This expressly includes ordinary negligence involving:

• The selection, description, or use of a Hunt location.
• The placement, monitoring, protection, or removal of a clue, token, container, or prize.
• A failure to inspect, identify, correct, supervise, secure, or warn about a condition.
• Crowd, traffic, security, or event management.
• Hunt instructions, maps, clues, posts, announcements, or corrections.
• Emergency response or the lack of immediate assistance.
• The conduct of another participant or member of the public.

You also agree not to sue a Released Party for any claim covered by this release.

This release does not apply to liability that applicable law does not permit to be released or waived. You understand that this section affects substantial legal rights.

11. Emergency and Medical Matters

CashStash KC does not provide medical screening, safety supervision, transportation, security, or emergency services unless expressly stated for a specific event.

CashStash KC may contact emergency services if it becomes aware of an incident. Each participant remains responsible for seeking help, contacting 911, and stopping participation when appropriate.

12. Indemnification

You agree to defend, indemnify, and hold the Released Parties harmless from third-party claims, damages, fines, penalties, expenses, and reasonable attorney fees arising from:

• Your unlawful, unsafe, reckless, dishonest, or destructive conduct.
• Your violation of these Terms or Hunt-specific rules.
• Injury or property damage caused by your actions.
• Your infringement of another person's privacy, publicity, intellectual property, or other rights.
• Content, statements, or evidence you submit in connection with a Hunt.
• A dispute between you and a teammate, guest, or other participant.

This section does not require indemnification for liability that applicable law does not allow to be shifted.

13. Hunt Administration

CashStash KC may establish Hunt dates, boundaries, clue schedules, prize locations, entry methods, claim deadlines, and verification requirements.

Unless otherwise stated:

• Times are based on Central Time.
• CashStash KC's records and the applicable platform's time stamps control.
• CashStash KC may issue corrections, added clues, safety notices, or location changes.
• Only statements made through official CashStash KC channels are authorized.
• Rumors, comments, reposts, fan accounts, and statements by unaffiliated people are not official instructions.
• CashStash KC's reasonable, good-faith interpretation of Hunt rules and evidence is final to the fullest extent permitted by law.

14. Claiming a Prize

Finding, touching, possessing, photographing, or reporting an item does not automatically make someone a verified winner.

To claim a prize, a participant may be required to:

• Follow the claim instructions for that Hunt.
• Lawfully retrieve the designated item, token, or code.
• Contact CashStash KC within the stated claim period.
• Keep any private verification code confidential until instructed otherwise.
• Provide the original item, unedited photographs or video, location information, time information, witness information, or other reasonable evidence.
• Provide proof of age, identity, and eligibility.
• Sign an eligibility confirmation, receipt, publicity release, tax form, or additional liability release where lawful.
• Return any reusable container, equipment, or property identified as belonging to CashStash KC or a sponsor.

The winner is the first eligible participant whose lawful claim is verified by CashStash KC, not necessarily the first person to comment, send a message, or state that they found it.

CashStash KC may reject a claim when the prize was obtained through trespassing, dangerous conduct, cheating, tampering, fraud, rule violations, or help from an ineligible person.

15. Teams and Shared Searches

Participants may work together unless Hunt-specific rules prohibit it.

CashStash KC may award the full prize to one verified claimant and has no duty to divide a prize among teammates, family members, drivers, tip providers, or collaborators.

Any promise to split or share a prize is a private agreement between those people. CashStash KC is not responsible for enforcing or resolving such agreements.

16. Prize Conditions and Taxes

Prizes are awarded as described in the Hunt-specific rules, subject to verification and applicable law.

• A prize may not be transferred before it is awarded.
• Merchandise prizes are provided as-is, subject only to warranties offered by the manufacturer or prize provider.
• CashStash KC may substitute a prize of equal or greater value if the stated prize becomes unavailable.
• Winners are responsible for taxes, fees, reporting duties, travel costs, and other expenses associated with accepting or using a prize.
• CashStash KC may require a completed IRS Form W-9 or other tax information before awarding a reportable prize.
• Sensitive tax information should be provided only through a secure method approved by CashStash KC, never through a public comment.
• Failure to provide required verification or tax information by the stated deadline may result in forfeiture.
• No person has a legal right to a prize until CashStash KC completes verification and confirms the award.

17. Lost, Removed, or Tampered-With Prizes

A clue, token, container, or prize may be moved, damaged, stolen, opened, copied, or removed by an unauthorized person.

If this happens, CashStash KC may:

• Pause the Hunt.
• Change or withdraw a clue.
• Relocate or replace the prize.
• Review recordings, time stamps, witnesses, and other evidence.
• Award the prize to the eligible participant CashStash KC reasonably determines would have completed the Hunt first.
• End or modify the Hunt as permitted by law.

CashStash KC is not responsible for reimbursing travel, fuel, parking, lodging, missed work, purchases, or time spent participating.

18. Online Hunts and Technology

Online Hunts may depend on websites, social platforms, mobile devices, messaging services, GPS data, internet access, or third-party systems.

CashStash KC does not guarantee that:

• A post, clue, message, page, or stream will be available without interruption.
• Every participant will receive content at the same time.
• A platform will display comments or messages in exact chronological order.
• GPS coordinates, maps, tags, captions, or notifications will be error-free.
• An entry or message delayed by a third-party system will be received before a deadline.

Bots, scripts, automated entries, scraping tools, account manipulation, multiple false identities, hacking, location spoofing, forged time stamps, and other technical manipulation are prohibited.

19. Fraud and Impersonation Warning

Only rely on CashStash KC accounts and websites identified through official CashStash KC channels.

CashStash KC will not require a winner to provide a password, login code, gift card, cryptocurrency payment, or advance fee to release a prize.

CashStash KC is not responsible for scams, fake accounts, copied content, phishing messages, or false prize notices created by unaffiliated people. Report suspected impersonation directly to CashStash KC and the platform involved.

20. Social Platform Disclaimer

Unless expressly stated otherwise, a Hunt is not sponsored, endorsed, administered by, or associated with Instagram, Facebook, TikTok, YouTube, X, Discord, or any other social platform used to promote or administer it.

Each participant releases those platforms from claims arising from or related to the Hunt to the fullest extent permitted by law.

Questions, complaints, or claims regarding a Hunt must be directed to CashStash KC, not the social platform.

21. Sponsors, Venues, and Prize Providers

A sponsor, venue, property owner, or prize provider may have separate rules, hours, eligibility requirements, or conditions.

The use of a sponsor's name or branding does not mean the sponsor controls the Hunt or guarantees participant safety unless Hunt-specific rules expressly state otherwise.

CashStash KC may share necessary winner information with a sponsor or prize provider to verify eligibility, fulfill the prize, prevent fraud, or comply with law.

22. Photographs, Video, Publicity, and Submitted Content

Hunts and organized CashStash KC events may be photographed, filmed, livestreamed, or recorded.

Where permitted by law, a verified winner grants CashStash KC permission to use the winner's name, voice, city, likeness, statements, submitted media, and prize information for Hunt reporting, advertising, and promotion without additional payment or approval.

When you submit, tag, or send content to CashStash KC in connection with a Hunt, you confirm that you have the right to submit it. You grant CashStash KC a nonexclusive, worldwide, perpetual, royalty-free license to use, reproduce, edit, crop, publish, display, and distribute that content for business and promotional purposes.

CashStash KC will not knowingly use an identifiable minor's likeness in paid advertising without permission from a parent or legal guardian.

23. Privacy

CashStash KC may collect information reasonably needed to administer a Hunt, verify eligibility, prevent fraud, contact a winner, deliver a prize, publish winner information, and comply with tax or legal duties.

Do not submit private or sensitive information in public comments. Marketing messages will be sent only as permitted by law and any consent provided by the participant.

CashStash KC does not knowingly accept Hunt entries or personal information directly from children under 13.

24. Conduct and Disqualification

CashStash KC may disqualify a participant, refuse a claim, revoke an unfulfilled prize, remove someone from an event, or ban future participation for:

• Trespassing or illegal conduct.
• Unsafe or reckless behavior.
• Fraud, cheating, false evidence, or misrepresentation.
• Threats, harassment, stalking, violence, or unwanted physical contact.
• Tampering with a clue, prize, container, post, account, or Hunt system.
• Property damage, littering, or disruption of a business or public area.
• Interference with another participant's lawful search.
• Impersonating CashStash KC, a sponsor, or a participant.
• Violating these Terms or Hunt-specific rules.

CashStash KC may report suspected criminal activity to law enforcement and may provide relevant evidence to property owners, platforms, insurers, sponsors, or authorities.

25. Changes, Delays, Suspension, and Cancellation

CashStash KC may delay, pause, relocate, modify, or cancel a Hunt when reasonably necessary because of:

• Weather or environmental conditions.
• Safety or security concerns.
• Property closures or loss of permission.
• Law enforcement or government instructions.
• Illness, emergency, fire, flood, natural disaster, or other conditions beyond reasonable control.
• Theft, tampering, fraud, technical failure, or platform outage.
• A mistake in a clue, rule, prize description, or announcement.
• Sponsor or prize-provider issues.

CashStash KC will provide notice through an official channel when reasonably possible. Any prize will be handled according to the applicable Hunt rules and law.

26. Disclaimer of Warranties

To the fullest extent permitted by law, Hunts, clues, posts, maps, locations, tokens, containers, and related services are provided "as is" and "as available."

CashStash KC does not guarantee safety, accessibility, accuracy, availability, fitness for a particular purpose, uninterrupted operation, or any specific experience or result.

27. Limitation of Non-Injury Damages

To the fullest extent permitted by law, the Released Parties will not be responsible for indirect, incidental, special, exemplary, punitive, or consequential damages arising from a Hunt, including lost income, lost data, travel expenses, device damage, or loss of opportunity.

This provision does not limit liability where such a limitation is prohibited by law.

28. Governing Law and Venue

These Terms are governed by Kansas law, without regard to conflict-of-law principles.

Before filing a legal claim, the participant must send written notice describing the dispute and allow CashStash KC 30 days to attempt an informal resolution.

Any claim that is not waived or resolved informally must be brought exclusively in a state court located in Johnson County, Kansas, or in the United States District Court for the District of Kansas. Each participant consents to personal jurisdiction in those courts.

This section does not restrict any right or forum that applicable law does not permit the participant to waive.

29. Severability

If any portion of these Terms is found invalid or unenforceable, it will be limited or removed only to the minimum extent necessary. The remaining provisions will remain in effect.

30. No Waiver

CashStash KC's failure to enforce a provision in one instance does not waive its right to enforce that provision later.

31. Entire Agreement

These Terms, together with applicable Hunt-specific rules and any signed release, form the entire agreement concerning participation in a Hunt.

A statement made by another participant, sponsor employee, volunteer, social media user, or unaffiliated person does not modify these Terms.

32. Updates to These Terms

CashStash KC may update these Terms by posting a revised version with a new effective date. The version in effect when a Hunt begins will generally apply to that Hunt. New safety notices may take effect immediately when reasonably necessary.
